Regulate property purchases

The law could give municipalities the opportunity to regulate settlements and property purchases from July 2025.

The law allows the municipality to determine the desired population in a decree, which cannot be less than the population in force in the year the decree comes into force. Legal protection measures can only be applied if the settlement has reached this threshold.

 

The law precisely defines who qualifies as a settler: a natural person who does not own real estate or reside in the settlement and wishes to acquire real estate or establish a residence in the settlement. However, it also establishes several exceptions, for example, a person whose place of origin is the settlement or who is a relative of a person who owns real estate or resides in the settlement is not considered a settler.

 

The draft law on the protection of local identity offers five options to municipalities that feel that the various waves of emigration are threatening the structure, community or infrastructure of the given municipality.

 

These are:

- restricting the acquisition of real estate,
- generalizing the right of pre-emption for local residents,
- making the acquisition of real estate conditional,
- making the establishment of a residential address conditional,
- introducing local taxes.

 

According to Minister Tibor Navracsics, the biggest controversy among these is caused by the restriction on real estate acquisition, so if these discussions continue, this element may even be removed from the bill, but the other four elements also provide sufficient guarantees for the settlements.
